EA Seeking First Amendment Right For Depiction of Battlefield 3 Helicopters

A lawsuit was filed last Friday against EA by Textron, the parent company of Bell Helicopter. According to the suit obtained by Kotaku, Textron's lawyers demanded that EA cease it's depiction of Bell's helicopters in Battlefield 3 on December 21st. The talks broke down and the lawsuit was filed against EA.

The Bell-manufactured helicopters depicted in Battlefield 3 are just a few of countless creative visual, audio, plot and programming elements that make up EA's expressive work, a first-person military combat simulation

EA is confident that the depiction of the helicopters in Battlefield 3 "are protected by the First Amendment and the doctrine of nominative fair use." Also noted is that the cover of BF3 has a disclaimer that states "the appearance of real-world weapons and vehicles does not constitute any official endorsement by their maker." Adding that the Bell helicopters are not given any prominence over other vehicles in the game. The three helicopters are the AH-1Z Viper, UH-1Y, V-22 Osprey (singleplayer only).

why now, why this game? every other first person shooter has them, they gonna demand the removal of them from every game?

It's just another example of a company pointlessly suing to make some money.
Even if they lost this lawsuit, couldn't they just change something very minor, and the name and then continue to have it in the game?

So wait. MW3 has an AH-1Z, I'm 100% sure of that. Previous COD and BF games have had them. So why this all of a sudden? Doesn't make sense. I'm pretty sure that will hurt their case quite a bit.

I don't even get why they are suing EA. Because the Viper, Huey and Osprey were included in the game without their permission/they didn't get their slice of the pie?

Far from new, but I doubt they will get a dime out of this. There has to be something else because imagery is not considered proprietary unless it it a symbol or marks a product or idea. they also cannot file a defamation case as the vehicles are balanced the same and nothing looks bad as a result of this game. I would really like to see a link OP is thats possible. there is very little information here for everyone to be rushing to judgment.

what a joke,next thing ya no all weapon manifactuers will do the same then we will only have water pistols and even then mattel(toy maker) will jump on the band wagon and probly do the same for those . farrrrrrrrrkin joke a

Oh sorry, I forgot you American's have been suing the pants of each other for decades :razz: . Here in Australia its barely caught on, thankfully.
